    I worked for Amazon, had a few issues with employees over a female . Management never did anything and I was just gonna leave. Had a few months before deployment so I didn’t really care. I would go to work, badge and clock in then leave. Then on the phone I’d clock out on the app, I’d get paid for the day and the next week I resigned. Should I be worried?

    I received a EEOC granted notice to Sue (under theEPA)letter as of June 25, 2024.I walked in to the EEOC local department on June 25, 2024 after I had filed multiple complaints and already set a appointment for December 12,2024 .I explained my situation when I arrived to the secretary at the front desk I am also covered under the ada. She then granted me my letter to Sue in federal court. I am aware of the 90 day timeline. I have been searching for a attorney in the area to no avail. what’s next for me?

    Hey Vince, thanks for the response video! Im actually in a for cause state. Pretty easy to figure out the state...Yes, there is tons of behind the scenes stuff going on. I definitely feel like lucky compared to most stories I've heard about WC retaliation. One thing I've figured out is that the system is definitely broken. Get an attorney, but be your own advocate. No one will fight harder for you, then you...Dont make money the end game. Fight for the next person!

    I am a litigant in person applying for summary judgement for part of my claim. I am confused as to which documents need to accompany my initial application form and witness statement? Do I just add a schedule of exhibits document alongside the witness statement and then once I receive the defence witness statement and exhibits, create a bundle with mine, theirs and add add in my statement of case and their defence? At which point is everything put together into one running document for the judge to review, pls? I’m guessing it obviously can’t be at the start of the application? (I’m in the UK, but pls do not worry about being specific to here). Many thanks

    I knew to go to EAP for myself. To this day, my therapist does not submit documentation to my previous employer. I spoke to some one from my previous employer and all he kept telling me was, “I need to take a break.” I was like, “um, okay?!”

    what r ur thoughts on MALDEF (the equivalent of NAACP for Hispanics) especially if u want ur case to be a litigation vehicle to change not only ur employer but the industry (esp if u suspect that they’re not the only ones systemically discriminating against the advancement of hispanics to leadership roles)

    Thank you for discussing this, I don't have a platform to encourage employees to be weary of EAP. The thing about employees weaponizing EAP, it re- traumatizes you. I need mental healthcare after experiencing workplace trauma but I have lost trust in it because of my experience with EAP therapists and a EAP consultant I was forced to engage with as a directive. I can not wait for my attorney to depose these people. I'm interested in seeing how they will explain and justify their complicity. My trial is scheduled for December of this year.

    I was fortunate to get a honest HR employee and have went to psychologist referred by EAP for 16 years. He has done nothing but help me an gave me backbone to fight. But I pay for it.

    Vince could a disabled plaintiff utilizing vocational rehabilitation services from a state government agency tasked with providing them be considered mitigating damages, especially if finding the same or similar job is basically impossible given macroeconomic conditions and/or actions of the former employer?

    Vince it's Stace' so after 21 months I finally got my RTS (without findings) the EEOC never really did an investigation because they're so short staffed (went through 3 investigators that all quit) so I kinda got the EEOC shuffle and forgotten about. Anyway, last August, I signed a (Retainer Agreement) with a law firm ( I haven't paid a dime so far) and they now said the Partners have to vote on taking my case. Mediation has never been discussed (ex Company may have turned it down during the EEOC process IDK) I'm not sure how to feel about all of this.. I've never heard of a vote, and now I'm wondering if I should be calling other lawyers? I'll take any advice at this point. My deadline to file in Federal Court is September 8th. I've had an attorney (not a partner) up until this moment, so I'm assuming the real lawyering may be done by one of the Partners of the firm in the event we go to trial... hence the Partner vote. How does this work, Vince?

    The EEOC came back and asked us for our posistion statement. I provided the investigator ( not EEOC ) whom my attorney asked to work on this with my posisiton statement, rebuttal what ever it should be called. The investigator turned around, I assume read over it along with all of the supporting evidence I sent to them and sent all of it to the EEOC with just a cover letter. No body was added to the cover letter. it was just name address and lawfirm info. Followed by what I wrote. Is this normal????? I'm scratching my head on this one. Maybe the investigator picked up the phone and spoke to the EEOC investigator about my case and why they were sending it just as I wrote it along with all supporting docs I provided. I thought my investigator that my attorney asked to work on this would at least take what I provided and write it in legalese terms.

      You are protected by HIPAA. So mental/medical records cannot be released to your employer.

    EAP programs exist to screw over employees. The first thing a toxic company does is keep an eye on the employees they destroy by using EAP programs.

    VINCENT - Are you able to represent IL Human Rights case? Wasn’t sure how that worked since they also work alongside EEOC. If you are, any interest in taking on my former employer (a sch district), and also potentially hospital and the state of IL?? Summary: Violent crime victim not at work, FMLA/VESSA leave, fired, then the chain of hell began to get even worse from there.

At the beginning of the year our labor got cut, and Maintenace took the brunt of losing shifts. I got cut from 40 hours to 16 right as winter was starting, and just this week got further cut to 8. HOWEVER, one of the bosses friend's son has been on the schedule 40 hours consistently the entire time, how is that fair? I understand it might be legal, but its completely unfair. Why does that guy get to pay his bills and I don't. Doesn't make any sense. Id like to hear your thoughts on what i should do.

HOWEVER, one of the bosses friend's son has been on the schedule 40 hours consistently the entire time, how is that fair? I understand it might be legal, but its completely unfair. I was on work comp working light duty and 8 weeks later fired while on work comp actually Thursday this week was my last day, . Harassment, hostile work environment, discrimination all began the minute i went on work comp. would this be worth contacting a attorney? I appreciate your videos.

    Vince, I don't think a practicing attorney can ever "talk as a layperson." An attorney can deny giving legal advice, but he cannot disavow his level of knowledge and experience and professional licensure. What does the law say on this?

    What should I do If the company I worked wont give me termination letter? I sent via E-mail to my boss to provide me with the letter. But he did not respond. But he still doesn't want me to come back to work. How many letters I have to send?if they still don't answer or give termination letter. They did this to other employees too. They just left no termination letter. There is no use to complain to new HR. Because the decision is on my Boss. My boss had been there for a almost 29 years and best friend with CEO. No wonder the HR boss come and go very fast. Basically HR for decoration only or puppet. My boss the one who controlled them.

    Love your videos! My question is: Would there be a point in the process, considering if or when the defense does not file for summary judgement, that the plaintiff should? Of course, this scenario would be applicable in the event that the plaintiff's case had merit and substantial evidentary documentation. Trying to understand the process and if the defense would not file only if they may not prevail at trial.

    What if your employer has gone though the progressive disciplinary process (per union contract) and has technical basis for the policy violations, however such circumstances developed following return to work from disability leave. This led to termination in just a 4 month. Previous employment record spotless over 10 year career with employer. Such actions were also being taken after my request for accommodations and reports of workplace harassment/discrimination. Most of the offenses were directly tied to my disability conditions being caused by workplaces treatment / environment. and request for accommodations, including intermittent accommodation request submitted while I was appealing initial denial was ongoing, were not provided Is this retaliation or for cause?
